By accessing or using dwellHQ (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

These terms apply to all users of dwellHQ, including homeowners, landlords, property managers, and contractors.

2. Description of Service

dwellHQ is a property management and marketplace platform that helps users track renovation projects, manage materials, store receipts, coordinate with contractors, post projects for bids, and access AI-powered property insights.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@dwellhq.io if you suspect unauthorized access to your account.

You must be at least 18 years old to use dwellHQ. By creating an account, you represent that you meet this requirement.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Upload or transmit malicious code, viruses, or any harmful content
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Use the Service to harass, abuse, or harm others
• Scrape, crawl, or systematically extract data from the Service without our written permission
• Misrepresent your identity or impersonate another person or entity
• Submit false or fraudulent bids, reviews, or contractor credentials

5. Contractor Marketplace

dwellHQ facilitates connections between property owners and contractors. We do not employ contractors and are not a party to any agreements made between users. dwellHQ LLC is not responsible for the quality, timeliness, or outcome of any work performed by contractors found through the platform.

Contractors are responsible for maintaining accurate profiles, valid licenses where required, and professional conduct. Homeowners and landlords are responsible for independently verifying contractor credentials before engaging their services.

6. Subscription and Billing

dwellHQ offers free and paid subscription tiers. Paid plans are billed on a monthly or annual basis as selected at checkout.

All fees are non-refundable except as required by applicable law or as otherwise stated in our refund policy. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

We reserve the right to change pricing with at least 30 days' notice to existing subscribers.

7. AI Features

dwellHQ includes AI-powered features provided through Anthropic's Claude API. AI-generated responses are for informational purposes only and do not constitute legal, financial, or professional advice.

You acknowledge that AI responses may occasionally be inaccurate or incomplete. Always verify important information with qualified professionals before making decisions.

Do not input sensitive personal information (passwords, financial account numbers, government IDs) into AI-powered features.

8. Limitation of Liability

To the maximum extent permitted by law, dwellHQ LLC and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

The Service is provided “as is” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Governing Law

These Terms of Service are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of New York State.
